This Privacy Policy explains how CLIMENTE ALIN IONEL PFA ("we", "us", "our") handles personal information when you visit the tabsprospector website or purchase our software licenses and services.
1. Static Website Data Handling
Our website is strictly static. We do not run automated analytics tools, tracking pixels, or cookie-based session trackers on visitors.
2. Communications & Direct Sales
When you contact us directly via email (alinclimente@softgata.com) or complete a direct purchase via bank transfer, we retain your email address, billing name, fiscal tax identifiers (where applicable), and communication history exclusively to:
- Process legal invoices under Romanian tax regulations.
- Deliver software archives (ZIP files).
- Coordinate Guided Setup support calls and manage Fully Managed VPS deployments.
We do not sell, rent, or share your contact or billing information with third parties.
3. On-Premise & Managed Instance Privacy
The core tabsprospector application is designed to run self-hosted on your private infrastructure or within an isolated, single-tenant container.
- Self-Hosted & Guided Tiers: Your prospect data, database entries, screenshots, and pipeline details remain entirely on your own server. We have zero access to your database.
- Fully Managed Tier: Your instance is isolated. Data passed through the Google Gemini API relies directly on the API key provided by you and is subject to Google's Privacy Policy. We do not access, mine, or monetize your stored CRM records.
4. GDPR Rights & Statutory Retention Exceptions
Residents of the European Economic Area (EEA) have the right to request access to, correction of, or restriction of their personal data. However, the right to erasure ("right to be forgotten") under Article 17(3)(b) of the GDPR does not apply to personal data contained within fiscal invoices, receipts, or accounting records.
Under Romanian fiscal legislation (law enforced by ANAF), we are legally mandated to retain all transaction records and tax invoices for a minimum statutory period of 5 years (or longer if required by active tax codes) following the end of the financial year in which the transaction occurred. Non-billing correspondence or marketing communications may be erased upon request by contacting alinclimente@softgata.com.
Terms of Service & License Agreement

By purchasing, downloading, or requesting deployment of tabsprospector from CLIMENTE ALIN IONEL PFA, you agree to these Terms of Service. If you do not agree, do not purchase or use the software.
1. Licensing Tiers & Scope
All prices listed on the website are final net amounts (the price displayed is the total price billed). Payments are settled exclusively via bank transfer.
- Self-Hosted ($149 One-Time): Grants a non-exclusive, perpetual, non-transferable license to deploy and run one (1) instance of the software for one (1) organization on one (1) server. Includes source code archive (ZIP) and setup documentation. Third-party VPS hosting, domain, and Google Gemini API usage costs are paid directly by the client.
- Guided Setup ($299 One-Time): Includes everything in the Self-Hosted Tier, plus a single 1-on-1 remote setup session (up to 3 hours maximum) to assist with deploying the application to your server, domain, and SSL configuration. Third-party VPS hosting, domain, and Google Gemini API usage costs are paid directly by the client.
- Fully Managed ($399/Year): Includes software licensing, single-tenant application deployment, automated database backups, ongoing server monitoring, and software version updates. Third-party VPS hosting costs and Google Gemini API token usage are separate and paid directly by the client. The client provides their own Gemini API key and selects/funds a VPS provider (e.g., ROMARG, Hostinger, DigitalOcean) sized appropriately for their team size and usage volume.
2. License Restrictions (No Reselling)
You are strictly prohibited from reselling, sublicensing, redistributing, sharing, renting, or leasing the source code or browser extension. You may not use the source code to build or market a competing commercial software product or public multi-tenant SaaS.
3. Setup Prerequisites & Subdomain Accommodation
For Guided Setup and Self-Hosted tiers, the client must independently acquire a server (VPS), a domain name,
and a Google Gemini API key prior to installation. If a client lacks a custom domain, CLIMENTE ALIN IONEL
PFA may, as a temporary courtesy, issue a custom subdomain (e.g.,
yourcompany.tabsprospector.com). This subdomain accommodation is provided at our sole
discretion and is guaranteed only while the primary tabsprospector.com platform remains
actively operated by us.
4. Subscription Renewal & Cancellation (Fully Managed)
The Fully Managed Tier recurs annually at $399/year for ongoing software deployment, server monitoring, database backup orchestration, and software updates.
If a subscription is cancelled or not renewed upon expiration, management services will cease immediately. We will remove our operational deployment access from your server, and no further application updates, bug fixes, or backup monitoring will be provided. The application will remain on your client-owned VPS in its last installed state.
VPS Sizing & Scale: The client is solely responsible for maintaining active billing and infrastructure with their chosen VPS host and Google Gemini API account. If team expansion or usage volume requires hardware scaling, the client must upgrade their server tier directly with their VPS provider.
5. Maintenance, Bugs & Feature Requests
- Critical Bug Fixes: License fees cover patches for critical software bugs that render the core application non-functional or unusable. Fixes will be issued via updated code releases.
- Client OS Maintenance: For Self-Hosted and Guided tiers, regular operating system
maintenance (e.g.,
apt upgrade, server security patches, and environment updates) remains the sole responsibility of the client. - Feature Requests: New features, custom integrations, or major framework enhancements are developed strictly at the sole discretion of CLIMENTE ALIN IONEL PFA and are not guaranteed under standard licensing.
6. Third-Party Services & Platform Changes
tabsprospector utilizes viewport screenshot extraction and third-party APIs (specifically Google Gemini). We
accept zero liability for third-party service interruptions, API deprecations, model name
modifications, pricing changes by Google, or downtime caused by host providers. In the
event Google deprecates an active LLM model, updating the model reference within the application
configuration (.env file) is required.
7. User Compliance & Data Gathering Liability
The client assumes full, sole legal responsibility for how they use tabsprospector, the data they collect, and their compliance with local laws (including GDPR and CAN-SPAM) and third-party Terms of Service (e.g., LinkedIn, Meta, X). CLIMENTE ALIN IONEL PFA is not liable for account warnings, restrictions, or suspensions resulting from outbound outreach or scraping activities.
8. Refund Policy
- Self-Hosted Upgrade Requirement: If a Self-Hosted ($149) customer cannot complete installation independently due to environment complexity, they may pay the price difference ($150) to upgrade to Guided Setup assistance.
- Defect-Based Refunds: Because downloadable source code is provided upon purchase, sales are generally non-refundable. However, if a verified core application bug prevents the software from operating entirely, we will issue a bug fix. If a reasonable bug fix cannot be provided within a reasonable timeframe, a full refund will be issued via bank transfer.
9. Limitation of Liability & Governing Law
To the maximum extent permitted by law, CLIMENTE ALIN IONEL PFA shall not be liable for any indirect, incidental, or consequential damages, loss of profits, data corruption, or third-party API usage fees. These terms are governed by and construed in accordance with the laws of Romania, with exclusive jurisdiction in the courts of Iași, Romania.
